Terms and Conditions

These Terms and Conditions (the “Terms”) govern your access to and use of the Land Ops Desk website and services (the “Site” and “Services”). By accessing or using the Site, you agree to these Terms.

Agreement between you and Land Ops Desk

Who we are, what these Terms cover, and what you agree to by using the Site.

1) Acceptance of Terms

The Land Ops Desk website (the “Site”) is made available by Land Ops Desk (the “Company,” “we,” “us,” or “our”). The Site is offered to you conditioned on your acceptance without modification of these Terms. By using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2) The Site is an e-Commerce Site

The Site may allow you to purchase Services and digital deliverables (for example, due diligence screens or reports). Pricing, what’s included, and availability may change at any time.

3) Our Services (scope + limitations)

Land Ops Desk provides informational research intended to help land investors screen parcels (the “Services”). We compile data from public records and third-party sources. Those sources can be incomplete, outdated, or incorrect. You are responsible for verifying critical items (including, without limitation, access, taxes, zoning, utilities, boundaries, encroachments, easements, and title status) with the appropriate authorities and qualified professionals.

No legal, tax, or investment advice. Nothing on the Site or in the Services is legal advice, tax advice, or investment advice. If you need advice, consult a licensed professional in your jurisdiction.

No fiduciary relationship. Your use of the Site and Services does not create a fiduciary relationship between you and Land Ops Desk.

4) Privacy

Your use of the Site is also subject to our Privacy Policy. Please review it carefully. By using the Site, you acknowledge the information practices described in the Privacy Policy.

5) Electronic Communications

Visiting the Site or sending emails to us constitutes electronic communications. You consent to receive electronic communications from us, and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

5A) Land Ops Desk SMS Program

Program and purpose. Land Ops Desk may offer optional SMS text-message services, including customer-requested account and credit-balance information. For the current account-balance SMS program, a customer requests a text through the Land Ops Desk website and receives an account-related message at the mobile number associated with the request or account.

Consent. SMS consent is optional, must be provided separately where required, and is not a condition of purchasing any Land Ops Desk product or service.

Message frequency and charges. The account-balance program sends one message per request. Other Land Ops Desk SMS programs, if offered, will disclose their applicable frequency at the point of opt-in. Message and data rates may apply.

Opt out and help. Reply STOP to unsubscribe from the applicable SMS program. Reply HELP for help, or contact [email protected] or +1 (213) 869-3578. If you opt out and later want to receive another applicable Land Ops Desk SMS, you must provide a new opt-in through the available Land Ops Desk consent flow.

Delivery. Wireless carriers are not liable for delayed or undelivered messages. Message delivery may depend on your carrier, device, coverage, and other factors outside Land Ops Desk's control.

Privacy. Mobile information and SMS opt-in data are handled as described in our Privacy Policy. We do not share mobile phone information with third parties or affiliates for their marketing or promotional purposes.

6) Your Account

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use or security breach. We may refuse service, terminate accounts, remove or edit content, or cancel orders at our discretion, subject to applicable law.

7) Children Under Thirteen

The Site is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you are under 18, you may use the Site only with the involvement of a parent or guardian.

Cancellation and Refund Policy

How refunds work for services, digital deliverables, and multi-pack credits.

Plain language: If work hasn’t started, refunds are simpler. Once we start or deliver work, refunds may be limited. Some states require certain refund rights; we comply with applicable law.

8) Cancellation / Refund Policy

Services (single purchases): If you request a refund within 30 days of purchase and we have not started work, you are entitled to a full refund (processing/document fees, if any, may be excluded where permitted). If work has started or the deliverable has been provided, refunds may not be available, but we may, at our discretion, correct issues, re-run items, or provide a credit.

Between 30 and 90 days after purchase, you may request a refund of 50% of the purchase price for any unused portion (for example, unused credits), where permitted by law. There are no refunds after 90 days.

9) Packs / Multi-purchase credits

If you purchase a pack of credits, refunds (if any) apply only to unused credits. Used credits (credits applied to completed work) are not refundable. Refund windows follow the same timeframes above: full refund for unused credits within 30 days, 50% refund for unused credits between 30 and 90 days, and no refunds after 90 days, subject to applicable law.

9A) Multi-Parcel and Bulk Due Diligence Submissions

Land Ops Desk may accept submissions containing up to 100 parcels in a single submission. Each parcel is treated as a separate due diligence request even when submitted together.

Required parcel information. Each parcel must include the required information shown on the submission form, including APN, County, and State. Land Ops Desk may reject or require correction of a submission containing missing, invalid, duplicate, or otherwise unusable required information.

Credits. For paid reports, the customer must have sufficient applicable credits for every parcel in the submission before the submission can be accepted. If sufficient credits are not available, the submission will not proceed and no batch credits will be deducted. When a paid multi-parcel submission is accepted, the required credits for the entire submission are deducted at submission.

Turnaround by parcel count. The standard turnaround schedule for accepted multi-parcel submissions is:

1–20 parcels = 24 hours
21–40 parcels = 2 business days
41–60 parcels = 3 business days
61–80 parcels = 4 business days
81–100 parcels = 5 business days

For this schedule, “business days” means Monday through Friday. The turnaround shown for the accepted submission is based on the number of parcels submitted and begins when Land Ops Desk accepts the submission after required information and applicable credits are successfully verified.

Free Preliminary Due Diligence is a one-time offer and is limited to one qualifying parcel; it is not available as a multi-parcel bulk benefit. Upgrade requests remain subject to verification of an eligible prior completed Preliminary Due Diligence request—free or paid—for the same customer and parcel. Each eligible Preliminary Due Diligence report may be upgraded only once.

9B) Full Due Diligence 24-Hour Guarantee

For qualifying Full Due Diligence requests, Land Ops Desk guarantees delivery within 24 hours after the request is accepted and all required parcel information and applicable credits have been successfully verified.

If a qualifying Full Due Diligence report is not delivered within that 24-hour period, the customer is entitled to a refund or replacement credit for that report.

The guarantee does not apply when completion is delayed by missing or incorrect customer-submitted information, customer-requested changes, unavailable or inaccessible third-party/public data sources, or other circumstances outside Land Ops Desk’s reasonable control.

Multi-parcel submissions remain subject to the turnaround schedule stated in Section 9A.

10) Chargebacks

If you have a billing concern, please contact us first so we can try to resolve it. Unauthorized chargebacks may result in account suspension and loss of access to Services, subject to applicable law.

Links, prohibited uses, and intellectual property

11) Links to Third-Party Sites / Services

The Site may contain links to third-party websites (“Linked Sites”). Linked Sites are not under our control, and we are not responsible for the content, accuracy, or availability of any Linked Site. The inclusion of any link does not imply endorsement. You access Linked Sites at your own risk.

12) No Unlawful or Prohibited Use

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Site in any way that violates any applicable law or regulation.
Attempt to gain unauthorized access to the Site, accounts, or systems.
Scrape, crawl, or harvest data except as permitted by law and our written permission.
Upload or transmit malicious code, or interfere with the Site’s operation.
Use the Site to infringe the rights of others.

13) Intellectual Property

The Site and its content (including text, graphics, logos, and software) are owned by or licensed to Land Ops Desk and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal or internal business use, subject to these Terms.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content without our prior written permission, except as allowed by law.

14) International Users

The Site is controlled and operated from the United States. If you access the Site from outside the U.S., you are responsible for compliance with local laws. We make no representation that the Site or Services are appropriate or available for use in all locations.

Disclaimers, liability limits, and indemnification

These sections matter. Read them carefully.

15) Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site is free of viruses or other harmful components. We do not warrant the completeness, reliability, or accuracy of any information obtained from public or third-party sources.

16) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LAND OPS DESK (OR ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS BEFORE THE EVENT FIRST GIVING RISE TO LIABILITY.

Some states do not allow certain limitations, so some of these limits may not apply to you. In that case, the limits apply to the maximum extent permitted by your state’s law.

17) No Personal Liability for Individuals

To the maximum extent permitted by law, you agree that any claim you may have arising out of or related to the Site or Services will be brought only against Land Ops Desk as a business entity, and not against its owners, officers, employees, contractors, or agents in their individual capacities.

This does not limit rights that cannot be waived under applicable law, and it does not prevent claims where individual liability is required by law.

18) Indemnification

You agree to indemnify, defend, and hold harmless Land Ops Desk and its affiliates, owners, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or Services, your violation of these Terms, or your infringement of any rights of another.

19) Termination / Access Restriction

We may terminate or suspend your access to the Site or Services at any time, with or without notice, if we believe you have violated these Terms or applicable law. Sections intended to survive termination (including disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

Dispute resolution, arbitration, and contact

How disputes are handled and how to reach us.

Note: Arbitration clauses can affect your rights. If you don’t want arbitration, don’t use the Site. If your state provides non-waivable rights, those rights still apply.

20) Informal Resolution First

Before filing a claim, you agree to contact us and provide a brief written description of the dispute and your contact information. We will try to resolve the dispute informally.

21) Arbitration Agreement (Binding)

If we cannot resolve a dispute informally, you and Land Ops Desk agree that any dispute arising out of or relating to these Terms, the Site, or the Services will be resolved by binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court if eligible.

This arbitration agreement is governed by the Federal Arbitration Act. The arbitration will be conducted on an individual basis, and class actions and class arbitration are not permitted.

If applicable law in your state does not allow arbitration of certain claims, those claims will proceed in court to the limited extent required.

22) Governing Law

These Terms are governed by the laws of the United States and, to the extent not preempted, the laws of the state where Land Ops Desk is organized or has its principal place of business, without regard to conflict of laws rules. If you reside in a state with non-waivable consumer protections, those protections apply.

23) Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect. These Terms (together with the Privacy Policy and any order-specific terms) constitute the entire agreement between you and us regarding the Site and Services.

24) Changes to Terms

We may update these Terms from time to time. The most current version will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted means you accept the updated Terms.
